Personal Training Services Agreement

This Services Agreement (“Agreement”) is between Matthew McDaniel doing business under

the name McDaniel Muscle Academy (“Trainer”) and the undersigned, physical training client

(“Client”), in connection with Client’s voluntary participation in any and all physical training

exercises whether at Trainer’s personal residence, outdoors, or within other facilities.

Medical History and Physical Capabilities

1. Trainer is not a medical professional and is without expertise to diagnose medical conditions or impairments. 2. Client certifies that he or she is physically capable of (a) participating in physical training exercises that may include, but are not limited to, strength, flexibility, cardiovascular, and aerobic exercises and (b) using the equipment associated with such exercises. 3. Client agrees to promptly and fully disclose to Trainer any injuries, conditions, or impairment that may have a deleterious effect on or be impacted by physical training exercises.

Implied Warranties or Representations

Client understands that there are no implied warranties or representations other than those expressly contained within this Agreement. Results will differ for all clients based upon various factors that include, but are not limited to: body type, nutrition, and work ethic during physical training sessions. Guarantees of weight loss, BMI, or agility results are not possible.

Session Payments and Makeups

1. Client agrees to pay in full to Trainer the predetermined weekly payment amount upon the Client’s first physical training session of the training week. 2. Client agrees that if after paying to Trainer the weekly payment, Client does not attend a scheduled physical training session or sessions and is unable to reschedule a makeup session or sessions within the same training week, Client will not be reimbursed for the session(s) missed.

Lost or Stolen Personal Items

Trainer is not responsible for any personal items that are lost or stolen at Trainer’s personal residence, outdoors, or at other facilities.
