Client understands that there are significant risks inherent in physical training exercises, the use of communal physical training equipment, and training within the same facility as others. The risks of physical training exercises may include, but are not limited to: falls, sprains, strains, fractures, broken bones, impalement, and death. These injuries may occur as a result of the improper use of the physical training equipment by Trainer or Client, a manufacturing or design defect of the physical training equipment, or the malfunction of the physical training equipment, whether or not due to the negligence or omissions of Trainer. Injuries that occur as a result of physical training exercises may be a first-time injury or the aggravation of a pre-existing injury. Other risks inherent in physical training exercises may include, but are not limited to: fainting due to overexertion, dehydration, or heat exhaustion in response to high temperatures at Trainer’s personal residence, outdoors, or within other facilities. The risks of the use of communal physical training equipment and training within the same facility as others may include, but are not limited to: bacterial infections, communal illnesses, or death. Client understands and agrees that despite the risks inherent in physical training exercises, the use of communal physical training equipment, and training within the same facility as others, Client willingly and voluntarily assumes full responsibility for the risks Client is exposing himself or herself to and accepts full responsibility for any injuries or death sustained by Client arising from Client’s participation in any and all physical training exercises due to the negligence of Client, Trainer, or third parties.

Client agrees to release Trainer from any and all liability, claims, demands, actions or rights of action if Client suffers injury or death arising from participation in any and all physical training exercises due to the negligence of Client, Trainer, or third parties. This waiver is binding upon Client and Client’s successors, representatives, heirs, executors, assigns, or transferees. If any portion of this Waiver is held invalid, Client agrees that the remainder of this waiver will remain in full legal force and effect.

Client agrees to accept all financial responsibility for any injury Client suffers or causes to any third party due to his or her own negligence. If Trainer is required to incur attorney’s fees and costs to enforce this Waiver, Client agrees to reimburse Trainer for such fees and costs. Client further agrees to indemnify and hold harmless Trainer from liability for any injury or death arising from participation in any and all physical training exercises due to the negligence of Client, Trainer, or third parties.
